Election Rules

ELECTION RULES

1. These rules shall be called “The Greater Lahore Cooperative Housing Society Ltd. Election Rules” and are being framed under the provisions of society’s Bye-Laws No.29(30) AND 26(2).

2. DEFINITIONS

a. “Act” means the cooperative societies Act 1925.

b. “Society” means “The Greater Lahore Cooperative Hosuing Society”

c. “Chairman”,  “Vice Chairman”  and  “Secretary” respectively means the Chairman, Vice Chairman and Secretary of the above noted Society.

d. “Registrar” includes a person upon whom powers of Registrar have been conferred under section 4 of the Act.

e. Defaulter” means and includes any member who has not paid any prescribed dues including cost of land and the installment of development charges due thereon till the day proceding the last day of filing of nomination papers.

f. “Voter” means a member of the Society who is not defaulter in the payment of any prescribed dues to the Society.

3. DISQUALIFICATION OF A CANDIDATE

Subject to the provisions of the Act. No person shall be eligible to contest the election to the Managing Committee of the Society if he suffers from any of the following disqualifications:

        a.  He is not a Voter.

        b.  He is not of the age 21 Years.

       c. He is not a member of the Society for the last one Year on the date of filing of nomination papers.

       d.  He is of unsound mind or mentally disabled.

     e.  He has been convicted of any offence involving dishonesty or moral turpitude to a sentence of whipping or imprisonment for a term exceeding six months.

      f.  No salaried employee of the Society shall be eligible to contest as a member of the Committee. However. any member receiving any honorarium from the Society shall not be deemed to be a salaried employee of the Society.

       g.  He is involved in business according to aims and objects of the Society.

       h.  He is in arrears of the Society’s dues in any way.

4. ELECTION PROGRAMME

The Managing Committee shall fix a date for the elections of members of the Committee, and shall duly cause a notice thereof to be sent by post to all the members and by publication in the press at least 15 days before the date so fixed. The notice shall contain the detailed programme of Election.

5. RETURNING OFFICER

The Secretary shall Act as the Returning Officer who. Assisted by the Legal Advisor of the Society, shall make all arrangements for holding the Elections in Accordance with these Rules.

6. NOMINATION PAPERS

Nomination papers in the form specified by the returning Officer shall be supplied to the contesting candidates during the office hours of the Socirty on payment of Rs.25/- per form.

7. SCRUTINY AND WITHDRAWAL OF NOMINATION PAPERS

a. Admission to the General Meeting shall be regulated strictly through Entry cards to be issued by the Society.

b. No member shall be allowed to participated or cast vote in the elections if he is in arrears of any dues to the Society. As per Bye Law . No 41(2) Entry Cards will bw issued to the voters only

c. Entry Cards shall be personally issued by the Returning Officer after due verification.

8. ADMISSION TO THE GENERAL MEETING

a.  Admission to the General Meeting shall be regulated strictly through Entry cards to be issued by the Society.

b.  No member shall be allowed to participated or cast vote in the elections if he is in arrears of any dues to the Society. As per Bye Law . No 41(2) Entry Cards will bw issued to the voters only

c.  Entry Cards shall be personally issued by the Returning Officer after due verification

9. CHAIRMAN OF THE GENERAL MEETING

The General Meeting shall be presided over by the Chairman or in his absence by the Vice Chairman of the Society as the case may be in case of their absence. Any member not being a candidate may be elected to preside over the meeting. By the majority of the members present in the General Meeting.

10. QUORUM

The quorum for the General Meeting shall be as laid down in Bye Law No. 19(2)

11. OBJECTION REGARDING ADMISSION

Any voter may object to the admission of any person in the General Meeting or raise any other objection regarding conduct of the Meeting which shall be decided by Chairman, whose descision shall be final.

12. VOTING PROCEDURE

Voting shall be held by secrat ballot as per the following procedure.

a. Each voter shall be issued one booklet containing nine ballot papers: one red ballot paper for Chairman’s election. One green ballot paper for Vice Chairman’s election. And seven white ballot papers for the election of other members.

b. Each candidate contesting the election shall be allocated one ballot box. Prominently nearing his name. Empty ballot boxes shall be seated by the Returning Officer in the presence of the candidates or their agents.

c. The ballot boxes shall be placed in a separate and secure enclosure and the members will be requires to cast their votes one by one ion full secrecy.

d. The votes will be counted under the supervision of the Returning Officer in the presence of three members selected at random by him,who shall not be the candidates or their agents.

e. For the posts of Chairman and Vice Chairman. The candidate securing the highest number of votes shall be declared elected to the respective posts.

f. For the other members , seven candidated securing the highest number of votes out of thr total candidates shall be declared elected in order of merit.

13. RESULTING OF ELECTIONS

The results of the Election shall be announced immediately after the completion of counting in case of equality of votes between two or more candidates, the Chairman shall decide the matter by drawing of lots in the presence of such candidates who may care to be present.

14. APPEAL

a. An appeal by a candidate or a voter, as the case may be, shall be made to the Registrar within 7 days of the date of election in respect of:-

(1) Qualification or Disqulification of a candidate .

(2) Eligible of a voter.

(3) Election procedure.

(4) Resulting of the election

b. Decision of the Registrar on appeal shall be final and conclusive .

c. The decision of the Registrar declaring the election of any member as invalid. shall not affect the business conducted by the Managing Committee with the participation of such members.
